Section 6.5.3: Consequential Damages & Liability Caps
Monetary caps on platform liability, exclusion of consequential losses, and claims limitations.

Consequential Damages & Liability Caps

Clear boundaries establishing the maximum legal liability of the platform operator.

To maintain affordable fee structures for all users, our legal liability is subject to strict monetary ceilings.

Core Architecture & Principles

  • Exclusion of Consequential Damages: No platform liability for lost profits, lost business opportunities, data loss, or indirect damages.
  • Monetary Liability Ceiling: Total platform liability capped at the cumulative fees paid by the user in the preceding 12 months.
  • Statutory Time Limit for Claims: Any formal legal claim arising from platform use must be filed within 12 months of occurrence.

Operational Process & Execution Flow

Risk Allocation

Users accept commercial business risk and are encouraged to maintain independent commercial insurance.

Dispute Filing Protocol

Commercial losses should be addressed via standard order escrow dispute mechanisms.

Claims Limitation

Review the Terms of Service for specific legal jurisdiction and limitation provisions.

Mutual Agreement

These liability limitations represent a fundamental, agreed-upon element of the commercial bargain between ePaisay and its users.
